Shipping & Delivery Policy

Effective Date: January 1, 2026

This Shipping & Delivery Policy governs the shipment and delivery of products, materials, and live goods purchased from Pennate. This policy applies in addition to Pennate’s Terms of Service and any applicable service-specific or product-specific policies.


Delivery vs. Shipping

Pennate offers both local delivery services and third-party shipping, depending on the product, destination, and order type.

  • Local Delivery refers to deliveries performed directly by Pennate or its subcontractors within approved service areas.
  • Shipping refers to fulfillment via third-party carriers such as USPS, UPS, FedEx, or freight providers.

Availability of delivery or shipping options is determined at checkout or prior to order confirmation.


Service Area Limitations

At this time, Pennate delivers live plant material only within the state of Florida.

If a customer arranges for shipped or delivered products to be transported outside of Florida after delivery, Pennate assumes no responsibility for compliance, survival, condition, or performance of the materials.


Delivery Scheduling

Delivery dates and windows are estimates and are not guaranteed.

Deliveries are scheduled based on route efficiency, availability, weather, and site access conditions. Pennate does not guarantee specific delivery times.

Failed or delayed deliveries resulting from access limitations, incorrect information, gated communities, or customer unavailability may be subject to rescheduling fees or treated as a failed delivery under Pennate’s Scheduling & Cancellation Policy.


Site Access & Drop-Off Location

The customer is responsible for identifying and providing a safe, legal, and accessible delivery location.

Deliveries are completed at curbside, driveway, or another immediately accessible location as determined by Pennate at the time of delivery.

Pennate does not move delivered goods beyond the designated drop-off point, including into backyards, structures, or landscaped areas, unless expressly agreed in writing.

All deliveries are subject to Pennate’s Site Access, Parking & Work Readiness provisions in the Terms of Service.


Customer Presence

Unless otherwise stated, the customer is not required to be present at the time of delivery.

If the customer is not present, Pennate will leave delivered goods in a location deemed reasonable and appropriate based on site conditions.

Pennate is not responsible for the consequences of delivery location decisions when the customer is unavailable or has opted not to be present.


Transfer of Ownership & Risk

Ownership and risk of loss transfer to the customer upon delivery to the designated location.

For shipped items, ownership and risk transfer upon tender to the carrier, unless otherwise required by applicable law.

Pennate is not responsible for theft, vandalism, weather exposure, or damage occurring after delivery or carrier handoff.


Condition of Goods

Customers are responsible for inspecting delivered goods promptly upon receipt.

Variations in color, size, texture, and appearance are inherent to natural materials and do not constitute defects.

Live plant material may exhibit normal signs of transport stress and environmental exposure.


Weather & Uncontrollable Delays

Weather, supply chain disruptions, carrier delays, or other events beyond Pennate’s control may affect shipping or delivery timelines.

Such delays do not entitle customers to refunds or compensation.


Governing Terms

This Shipping & Delivery Policy is incorporated by reference into Pennate’s Terms of Service. In the event of a conflict, this policy governs shipping and delivery matters.
