Pennate LLC — Terms & Conditions

By accessing this website, scheduling services, purchasing products, or otherwise engaging with Pennate LLC (“Pennate,” “we,” “our,” or “us”), you agree to the following Terms & Conditions (“Terms”). These Terms apply to all visitors, customers, clients, and users.
These Terms incorporate by reference any applicable policies published on our website, including but not limited to delivery policies, privacy policies, and service-specific terms. In the event of a conflict, the most specific and most current policy applicable to the service or transaction shall govern.
1. Scope of Services
Pennate provides professional landscape-related services and products, which may include but are not limited to:
- Landscape consulting and advisory services
- Landscape design and design-build coordination
- Irrigation diagnostics, assessments, and seasonal system resets
- Plant material sales and curated plant kits
- Educational content, guides, and planning resources
- Digital tools for visualization, planning, and product selection
- The availability, scope, and pricing of services may change at any time.
- Pennate may engage qualified subcontractors or third-party providers to perform portions of services. Pennate remains responsible only for services expressly contracted.
2. Use of Website & Digital Tools
You may use our website and digital tools for lawful, personal, or business purposes. You agree not to:
- Misuse or attempt to disrupt site functionality
- Copy, scrape, or redistribute proprietary content or tools
- Use the site for unlawful, abusive, or deceptive activities
- Access to certain tools, features, or digital services may require account creation, payment, or acceptance of additional terms.
3. Appointments, Scheduling & Cancellations
- All appointments are subject to availability and confirmation.
- Certain services require full payment or a deposit in advance to reserve a calendar slot.
- Missed appointments, late cancellations, or access issues may result in forfeiture of fees, depending on the service and notice provided.
- Specific cancellation terms may be communicated at booking and are considered part of these Terms.
4. Payments & Pricing
- Prices are listed in U.S. dollars unless otherwise stated.
- Payments are processed through secure third-party providers (e.g., Stripe, WooCommerce).
- Pennate does not store credit card information.
- Payment confirms acceptance of scope and reserves time and/or materials.
- Failure to provide required access, approvals, or information does not entitle a client to refunds.
Refunds, cancellations, and returns are governed by applicable service-specific policies published on our website.
5. Site Access, Parking, & Work Readiness
The customer is responsible for ensuring that the service location is accessible, safe, and ready for work at the scheduled time.
This includes, but is not limited to:
- Adequate street frontage, parking, and turnaround space for service vehicles, trailers, and equipment
- Legal and reasonably unobstructed access to the site
- Clear paths for foot traffic, staging, and material handling
- Compliance with applicable neighborhood, HOA, or municipal access rules
Pennate will make reasonable efforts to park legally and minimize disruption; however, Pennate is not responsible for street design, traffic conditions, parking availability, neighbor complaints, or municipal enforcement actions.
Temporary obstruction of street frontage, driveways, mailboxes, or refuse containers may occur during active service or delivery. Pennate does not guarantee avoidance of all obstruction while work is in progress.
If site conditions prevent safe, lawful, or practical access — including narrow streets, dead ends, restricted parking, insufficient turnaround space, or third-party interference — Pennate may modify the service approach, delay service, or suspend work.
Failure to provide adequate site access or work readiness may be treated as a late cancellation or no-show under Pennate’s scheduling and cancellation policies.
5.1 Gated Communities & Restricted Access
For properties located within gated communities, secured buildings, or restricted-access neighborhoods, the customer is responsible for ensuring that Pennate has uninterrupted access at the scheduled time of service or delivery.
This includes, where applicable:
- Providing valid access codes or credentials
- Arranging temporary or permanent vendor access
- Coordinating with security personnel or gate attendants
- Notifying HOAs or property management in advance
Pennate does not contact security offices, HOA representatives, or third parties to obtain access unless expressly agreed to in writing.
If Pennate is denied entry or delayed due to incomplete, incorrect, or missing access arrangements, the visit may be treated as a late cancellation or no-show. Applicable deposits or service fees may be forfeited, and rescheduling may require additional payment.
5.2 Animals & Sanitary Conditions
The customer is responsible for maintaining a safe and sanitary work environment. Pets must be secured and animal waste must be removed from all work and access areas prior to service.
Pennate reserves the right to suspend or abandon work if site conditions present health or safety concerns. Such conditions may be treated as an access limitation under Pennate’s scheduling and cancellation policies.
6. Service-Specific Terms
Certain services offered by Pennate are governed by additional, service-specific terms and disclosures.
By scheduling, purchasing, or receiving a service, you agree to the applicable service-specific terms published on this website, which are incorporated by reference into these Terms.

9. Intellectual Property
All content, tools, layouts, text, images, designs, and branding are the property of Pennate LLC unless otherwise stated. Unauthorized use, reproduction, or distribution is prohibited.
10. Photography, Documentation & Media Use
Pennate LLC may document its work through photography, video, or other visual media as part of normal professional operations. Documentation may occur before, during, and after services, including follow-up visits where applicable.
Such documentation may include, but is not limited to:
- Existing site conditions
- Work in progress
- Completed installations or services
- Materials, plants, systems, and construction details
All photographs and media captured by Pennate or its representatives are the sole property of Pennate LLC and constitute Pennate intellectual property.
Pennate may use such media for legitimate business purposes, including but not limited to:
- Project documentation and records
- Internal training and quality control
- Marketing, promotional, educational, and portfolio use
- Website, social media, proposals, and printed materials
Pennate does not intentionally capture identifying personal information. When feasible and appropriate, reasonable efforts will be made to avoid or obscure street addresses, house numbers, vehicle license plates, and other directly identifying markers when media is used publicly.
Documentation focuses on the work performed, materials used, and site conditions, not on individuals. Pennate does not use client names, personal information, or identifying details in marketing materials without prior authorization.
If a client has specific concerns regarding media use, such concerns must be communicated in writing prior to the commencement of services. Reasonable requests may be accommodated at Pennate’s discretion; however, documentation for internal, operational, and record-keeping purposes may still occur.
Documentation may also include aerial imagery, where lawful and appropriate, captured using unmanned aerial systems (drones) operated by or on behalf of Pennate in compliance with applicable laws and regulations.
11. User Submissions
Any feedback, ideas, suggestions, or submissions provided to Pennate may be used without restriction unless otherwise agreed in writing.
12. Disclaimers
- Services are provided “as is” and “as available.”
- Pennate makes no guarantees regarding outcomes beyond those required by law.
- Conditions, performance, and results may vary based on factors outside our control.
13. Force-Majeure
Pennate shall not be liable for delays or inability to perform services due to events beyond reasonable control, including weather events, natural disasters, utility interruptions, or governmental actions.
14. Right to Refuse Service
Pennate reserves the right to refuse or discontinue services if site conditions, safety concerns, or client conduct prevent reasonable execution of work.
15. Limitation of Liability
Pennate LLC shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services, website, digital tools, or products, even if advised of the possibility of such damages. To the maximum extent permitted by law, Pennate’s total liability shall not exceed the amount paid for the applicable service or product.
16. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes must be brought in a court of competent jurisdiction within Florida.
17. Updates to Terms
Pennate reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of revised Terms.
