Effective Date: January 1, 2026
These Landscape Consulting Service Terms (“Service Terms”) apply specifically to landscape consulting services provided by Pennate (“Consulting Services”). By scheduling or receiving Consulting Services, you agree to these Service Terms in addition to Pennate’s Terms of Service.
Scope of Consulting Services
Landscape Consulting Services provide professional guidance, analysis, strategy, and recommendations related to landscape design, plant selection, site conditions, irrigation concepts, and overall planning.
Consulting Services are advisory in nature and do not include construction, installation, supervision, project management, procurement, or ongoing maintenance unless explicitly stated in a separate written agreement.
Professional Judgment & Limitations
Recommendations provided through Consulting Services are based on visible site conditions, information provided by the customer, professional experience, and industry best practices at the time of consultation.
Actual outcomes depend on numerous factors beyond Pennate’s control, including site conditions, soil variability, weather, contractor execution, material availability, plant health, maintenance practices, and client decisions.
Pennate does not guarantee specific results, performance outcomes, or long-term success based on Consulting Services alone.
No Implementation or Oversight
Consulting Services do not include oversight, supervision, or responsibility for third-party contractors, installers, suppliers, or maintenance providers.
Any implementation of recommendations is performed at the customer’s discretion and risk unless Pennate is separately engaged under a written agreement for design, installation, or related services.
Site Access & Information Accuracy
Consulting recommendations rely on reasonable site access and accurate information provided by the customer.
Pennate is not responsible for limitations caused by restricted access, concealed conditions, incomplete information, or changes to the site occurring after the consultation.
Deliverables
Deliverables may include verbal guidance, written notes, sketches, diagrams, summaries, or conceptual materials, depending on the service selected.
Unless expressly stated otherwise, consulting deliverables are conceptual and informational only and are not intended to serve as construction drawings, engineering documents, or permitting materials.
Payment & Scheduling
Consulting Services may require full payment or a deposit in advance to reserve time on Pennate’s calendar.
Missed appointments, late cancellations, access issues, or incomplete site readiness may be subject to Pennate’s Scheduling & Cancellation Policy.
Intellectual Property
All consulting materials, recommendations, sketches, and documentation provided by Pennate remain the intellectual property of Pennate unless otherwise agreed in writing.
The customer is granted a non-exclusive right to use consulting materials for personal or project-specific purposes only.
Governing Terms
These Service Terms are incorporated by reference into Pennate’s Terms of Service. In the event of a conflict, these Service Terms govern the provision of Consulting Services.
