This Delivery & Drop-Off Policy defines the scope, limitations, and conditions under which Pennate provides delivery of mulch, soil, and other bulk landscape materials. These terms are intended to ensure safe, efficient service and to clearly establish the limits of Pennate’s responsibility.
Delivery Scope
All mulch, soil, and bulk material orders are provided as delivery-only services unless expressly stated otherwise in a written agreement executed by Pennate.
- Delivery includes transport and curbside or driveway drop-off only.
- Materials are delivered in bags or bulk form as specified at the time of purchase.
- No spreading, installation, bed preparation, relocation, or placement beyond the drop-off point is included.
Any additional labor or services require a separate consultation and a fully executed written agreement.
Drop-Off Location
Materials are delivered to a single, accessible drop-off location designated at the time of scheduling.
- Typical locations include curbside or driveway areas immediately accessible to the delivery vehicle.
- Materials will not be carried, transported, or moved beyond the designated drop-off location.
- Pennate does not move materials past gates, fences, steps, slopes, landscaped areas, or interior spaces.
The customer is solely responsible for ensuring the drop-off location is clear, accessible, and capable of supporting the delivery vehicle and materials.
Access & Site Conditions
Delivery access must safely accommodate standard delivery vehicles and equipment.
- Narrow streets, soft or saturated ground, low-hanging branches, overhead obstructions, or surface limitations may restrict access.
- Pennate reserves the right to modify the drop-off location or decline delivery if conditions present safety or property damage risks.
- Pennate does not drive on lawns, unreinforced surfaces, or areas susceptible to rutting, cracking, or structural damage.
Pennate is not responsible for pre-existing site conditions or damage resulting from conditions outside of our control.
Delivery Scheduling
Deliveries are scheduled based on availability, routing efficiency, and geographic location.
- Delivery days are typically scheduled on weekdays.
- Specific delivery times are not guaranteed.
- Estimated delivery windows may be provided as a courtesy only.
Failed deliveries due to inaccessible sites, incorrect information, or customer unavailability may require rescheduling and may incur additional fees.
Minimum Orders & Quantities
Minimum order quantities apply to all delivery services.
- Minimums are established to ensure logistical and operational efficiency.
- Exceptions may be granted at Pennate’s sole discretion.
- Any exception granted does not create an ongoing obligation or precedent.
Payment Terms
Payment in full is required prior to delivery unless otherwise agreed to in writing.
- Orders are not scheduled until payment has been received and confirmed.
- Accepted payment methods may include secure online payment links or approved electronic payment platforms.
- By placing an order, the customer acknowledges that delivery constitutes transfer of risk and acceptance of materials.
Pennate does not release materials or perform deliveries without confirmed payment.
Customer Responsibilities
By placing an order, the customer agrees to:
- Provide accurate delivery details and contact information.
- Ensure the drop-off area is accessible at the scheduled delivery time.
- Assume full responsibility for material handling, placement, and use after delivery.
Turf, Surface & Time-on-Ground Protection
Delivered materials may be heavy and may compress or damage turf, soil, or underlying surfaces if left in place.
- Pennate is not responsible for turf damage, soil compaction, staining, or surface degradation caused by material weight.
- The customer assumes all responsibility for timely relocation or use of delivered materials.
- Leaving bagged or bulk materials on lawns, landscaped areas, or unreinforced surfaces is done at the customer’s discretion and risk.
Delivery Address Accuracy & Authorization
The customer is solely responsible for providing an accurate delivery address and confirming authorization to deliver materials to that location.
- Pennate does not verify property ownership, residency, occupancy, or third-party consent.
- Delivery to the address provided by the customer constitutes successful fulfillment of the order.
- Pennate is not responsible for disputes, claims, or losses arising from incorrect, unauthorized, fraudulent, or misleading delivery instructions.
Theft, Loss & Post-Delivery Risk
All deliveries are completed via curbside or driveway drop-off unless otherwise agreed in writing.
- Materials become the customer’s responsibility immediately upon delivery.
- Pennate is not responsible for theft, vandalism, loss, or damage occurring after drop-off.
- Customers acknowledge that curbside deliveries are visible and may be exposed to third-party interference or removal.
Returns, Cancellations & Refunds
Due to the nature of bulk and bagged landscape materials, all sales are considered final upon delivery.
- Delivered materials are non-returnable and non-refundable once drop-off has occurred.
- Pennate does not accept returns of opened, handled, relocated, or stored materials.
- Customer error in quantity, product selection, or delivery address does not constitute grounds for a return or refund.
In the event of a verified error caused solely by Pennate (such as delivery of an incorrect product or quantity), Pennate may, at its sole discretion, offer a correction, replacement, or refund.
Any such remedy is limited to the original purchase amount and does not include compensation for labor, delays, or consequential damages.
Refusal of delivery does not constitute a cancellation once materials are dispatched.
Liability, Warranties & Material Acceptance
Pennate is not responsible for:
- Damage to underground, subsurface, concealed, or non-visible features, including but not limited to irrigation systems, drainage components, utilities, edging, hardscape elements, pavers, or landscape structures.
- Pre-existing site conditions or property defects.
- Material performance, longevity, or suitability after delivery.
- Natural variations in color, texture, moisture content, or appearance inherent to organic or bulk landscape materials.
All materials are delivered as-is and are deemed accepted upon drop-off. Pennate makes no warranties, express or implied, regarding materials once delivered.
Delivery Services vs. Project Work
Installation, spreading, grading, and landscape construction services are provided only under separately scoped and executed project agreements.
Delivery-only services are intentionally limited and do not imply responsibility for final appearance, installation outcomes, or material performance.
Policy Updates
Pennate reserves the right to modify this policy at any time. The version published on this website at the time of order governs all delivery services.
