These Digital Tools Terms (“Digital Terms”) govern the use of Pennate’s digital tools, applications, and software-based services, including but not limited to Pennate Canvas and Stock by Pennate (collectively, the “Digital Tools”).
By accessing or using any Digital Tools, you agree to these Digital Terms in addition to Pennate’s Terms of Service and Privacy Policy.
Purpose of Digital Tools
Pennate’s Digital Tools are designed to support visualization, planning, education, product exploration, and decision-making related to landscape concepts and materials.
Digital Tools are informational and exploratory in nature and do not replace professional judgment, site-specific evaluation, licensed services, or in-person consultation.
No Professional Advice
Outputs, recommendations, suggestions, or insights generated by Digital Tools are not professional advice and should not be relied upon as the sole basis for design, purchasing, installation, or construction decisions.
Pennate does not guarantee outcomes, performance, plant survival, system behavior, or regulatory compliance based on Digital Tool usage.
User Inputs & Assumptions
Digital Tool outputs are based on user-provided inputs, assumptions, generalized data, and internal logic models.
Pennate is not responsible for inaccuracies resulting from incomplete, outdated, or incorrect user inputs, site conditions, or external factors.
Data Collection & Usage
Pennate may collect non-identifying and aggregated data related to Digital Tool usage, including preferences, selections, geographic indicators, interaction patterns, and feature usage.
Such data may be used to improve Digital Tools, develop new features, analyze trends, support research, or inform commercial strategy.
Personally identifiable information is handled in accordance with Pennate’s Privacy Policy.
Intellectual Property
All Digital Tools, including software, logic, interfaces, designs, content, outputs, and underlying systems, are the exclusive intellectual property of Pennate unless otherwise stated.
Use of Digital Tools does not grant ownership rights or licenses beyond limited, revocable access for personal or authorized business use.

Availability & Modifications
Digital Tools are provided “as is” and “as available.”
Pennate may modify, suspend, discontinue, or restrict access to Digital Tools or features at any time without notice.
Pennate does not guarantee uninterrupted availability or compatibility across devices, browsers, or operating systems.
Third-Party Integrations
Digital Tools may integrate with or reference third-party platforms, services, or data sources.
Pennate is not responsible for third-party content, availability, performance, or changes beyond its control.
Accounts & Access
Certain Digital Tools or features may require account creation, login credentials, or paid access.
Users are responsible for maintaining the confidentiality of account credentials and for all activity occurring under their account.
Limitations of Liability
Pennate shall not be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use Digital Tools.
Use of Digital Tools is at the user’s own risk.
Governing Terms
These Digital Terms are incorporated by reference into Pennate’s Terms of Service. In the event of a conflict, these Digital Terms govern use of Pennate’s Digital Tools.
